Welcome to the Johnston & Murphy Web Site ("Site"). The "Site" is owned and controlled by Genesco Inc. ("Genesco", "We", or "Us"). Please review the following basic rules that govern your use of our Site (the "Agreement"). Please note that your use of our Site means that you agree to those rules.

CHANGES IN PRIVACY POLICY

We may from time to time change these rules. We will notify users of the site of any changes by posting the revised policy reflecting them with a new effective date on this page. Your use of our Site following any such change means that you agree to the rules as changed. These rules--specifically including the "Privacy and Customer Information Policy" below--apply to this website only and not to any other website or business activity of Genesco, Johnston & Murphy or any other division of Genesco.

  

PRIVACY AND CUSTOMER INFORMATION POLICY

We collect a variety of customer information in an effort to improve our customers' shopping experience. We recognize that we must maintain and use customer information responsibly.

We collect personal information necessary to process an order, a catalog request, a contest entry or a request to receive promotional emails from the consumer. This information includes name, address, city, state, zipcode, phone number, email address. For those users who have opted to register their personal profile with the Johnston & Murphy website by setting up an “account”, the above information, including additional “Ship To” addresses, can be reviewed and maintained by the customer by accessing it through the “My Account” link in the top navigation bar of the website’s pages. For those customers who have not registered a maintainable account on the site, they may contact Johnston & Murphy customer service at 1-866-536-0773 to have their information updated as needed.


We may use customer information for marketing and promotional purposes and may sell it to or exchange it with third parties. Categories of companies with which we may share information include other companies that we believe offer products and services that our customers may be interested in, either directly or through companies that market information about potential customers to other suppliers of products or services. If you would like to make sure that we never sell personally identifying information about you to third parties, just send an email message to Johnston & Murphy via the Contact Us page (please type "no third parties" in the message or subject of your email).

 

Notice of Financial Incentives

We offer various financial incentives. For example, we may offer special price discounts, rewards, coupons, services, and other benefits to customers who sign up to receive marketing communication. When you sign up to receive communications from us via email, SMS or direct mail, we collect personal information from you, such as identifiers (name, email address, phone number, address) and commercial information (purchase history). Participation in these programs is entirely optional. You may opt in by following the sign-up or participation instructions provided, and, for any ongoing benefits, you are free to opt-out at any time by following the unsubscribe instructions in the promotional emails or SMS messages or by contacting us at privacy@johnstonmurphy.com. Occasionally, we could provide additional terms and conditions for a financial incentive; in that instance, we will notify you when you sign up. The value of your personal information is reasonably related to the value of the offer or discount presented to you.

 

J&M Insiders

J&M Insiders is a voluntary brand affinity program. By joining J&M Insiders, you receive:

Under the CCPA, J&M Insiders is considered a Financial Incentive Program. To provide the incentives described above, we use personal information about you including name, phone number, email address, purchase history, birthdate, etc. to identify members of the program and provide appropriate messaging, experiences and deals. These financial incentives are reasonably related to the value of the personal information you provide.

We incur a variety of expenses related to the J&M Insiders program. We incur these expenses to offer a more personalized and relevant shopping experience. Expenses associated with the program include the costs to retain member data, putting together special communications for members, and providing special access to deals only available to members.   The expenses associated with the program incentives vary as they depend on individual member engagement with the affinity program, including amounts spent and frequency and types of discounts members decide to use.

 

Categories of Personal Information used by J&M Insiders:

Customers can choose to opt in and become a J&M Insiders member by asking a Team Member at a store, or by visiting www.johnstonmurphy.com/jminsiders.

Again, participation in the affinity program is entirely optional. If you no longer wish to be a J&M Insiders member, you can opt out at privacy@johnstonmurphy.com. You can exercise your right to opt out of J&M Insiders at any time. If you opt out you may not have access to J&M Insiders benefits.   

  

YOUR CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83, also known as S.B. 27, allows our California customers to request certain information regarding our disclosures in 2004, if any, of personally identifiable information to third parties for their own direct marketing purposes. We will attempt to provide you with the requested information within thirty days of receipt.

  

USE OF COOKIES

What is a cookie? A cookie is a piece of information that is sent to your computer's hard drive to help our site recognize you when you return to our site. Cookies are used as a standard practice by many sites. An example of how we use this function could be if you started to place items in your shopping cart, but then for some reason had to leave our site or shut off your computer. When you return to our site, the cookie would enable our site to recognize that you have returned and all the items you placed in your cart during an earlier session would still be in your shopping cart.

We also use cookies to determine the number of people that come to our site. It is important for us to understand the number of new customers using our site. USER COMMENTS, FEEDBACK, POSTCARDS AND OTHER SUBMISSIONS

Such disclosure, submission or offer of any Comments shall constitute an assignment to Genesco of all worldwide rights, titles and interests in all copyrights and other intellectual properties in the Comments. Thus, Genesco will own exclusively all such rights, titles and interests and shall not be limited in any way in its use, commercial or otherwise, of any Comments. Genesco is and shall be under no obligation (1) to maintain any Comments in confidence; (2) to pay to user any compensation for any Comments; or (3) to respond to any user Comments. You agree that no Comments submitted by you to the Site will violate any right of any third party, including copyright, trademark, privacy or other personal or proprietary right(s). You further agree that no Comments submitted by you to the Site will be or contain libelous or otherwise unlawful, abusive or obscene material. You are solely responsible for the content of any Comments you make. You agree that the Company may use and/or disclose information about your demographics and use of the Site in any manner that does not reveal your identity.

 

USER SUBMISSIONS

You may post or upload content you have created, including without limitation, photographs, your social media handle, videos, and comments (collectively, “User Submissions”) to your social media accounts. By posting and uploading User Submissions that you have tagged with #johnstonandmurphy or other Johnston & Murphy brand hashtags, you grant to Johnston & Murphy, its third-party service providers who provide content management services, and its retail partners (collectively, the “Licensed Parties”) the perpetual, irrevocable, royalty-free, fully-paid, non-exclusive, transferable right to use your Johnston & Murphy-tagged User Submissions in any manner to be determined in the Licensed Parties’ sole discretion, including but not limited to on their webpages, social media pages operated by Johnston & Murphy, and in other marketing, promotional and advertising initiatives, in any media now or hereafter known. The Licensed Parties may use, display, reproduce, distribute, transmit, create derivative works from, combine with other materials, alter and/or edit your User Submissions in any manner in their sole discretion, with no obligation to you whatsoever. You grant the Licensed Parties the right to use your username, real name, image, likeness, caption, location or other identifying information in connection with any use of your User Submissions. You hereby represent and warrant that (i) you own all rights in and to your User Submissions, (ii) you have permission from all person(s) appearing in your User Submissions to grant the rights granted herein; (iii) you are not a minor, and (iv) the Licensed Parties’ use of your User Submissions as described herein will not violate the rights of any third party or any law. You hereby release, discharge and agree to hold Johnston & Murphy, the Licensed Parties, and any person acting on Johnston & Murphy’s or their behalf harmless from any liability related in any way to the Licensed Parties’ use of your User Submissions.

  

COLORS

We have made every effort to display as accurately as possible the colors of our products that appear at the Site. However, as the actual colors you see will depend on your monitor, we cannot guarantee that your monitor's display of any color will be accurate.

We use a third-party service provider to serve ads on our behalf across the Internet and sometimes on this site. They may collect anonymous information about your visits to our Web site, and your interaction with our products and services. We may from time to time contract with third-party vendors to work on our behalf to provide ads to our customers via the Internet or to send direct mail or catalogs to customers whom we think may be interested in our products or services. SECURITY

Protecting your information is extremely important to us. We realize that prioritizing this issue will insure an exceptional shopping experience. To this end, we use Secure Sockets Layer (SSL) technology. SSL encrypts all personal information including your credit card number, name, and address. With encryption in place, only Genesco can decode your information.

You can insure your connection is secure by looking in the lower left-hand corner of your browser window. If you see an unbroken key or a closed lock (depending on your browser), the SSL is active and your connection is secure. Please note that SSL will not activate until you enter the login page after you have completed your shopping and are ready to check out.

You may also check your security level by looking at the URL line of your browser. When accessing a secure server, the first characters of the site address will change from 'http' to 'https.'

Please note that some versions of browsers don't permit communication even if the server is secure. This is also true of some firewalls. If for some reason you are unable to connect to our secure server or would rather place your order by phone, please call us at 800-424-2854. Orders may also be faxed to 800-654-2371.

INDEMNIFICATION

You agree to defend, indemnify and hold Genesco, its affiliates, subsidiaries, officers, directors, employees and agents harmless from and against any and all claims, damages, costs and expenses, including attorneys' fees, arising from or related to your use of the Site. This provision is unenforceable or inapplicable within the State of New Jersey.

  

MISCELLANEOUS

This Site is controlled and operated by Genesco from its offices in Nashville, Tennessee.

This Agreement shall be construed in accordance with the laws of the State of Tennessee, without regard to any conflict of law provisions. Any dispute arising under this Agreement shall be resolved exclusively by the state and federal courts of the State of Tennessee, County of Davidson and/or the Middle District of Tennessee.

  

TERMINATION

This Agreement is effective unless and until terminated by either you or us. Either of us may terminate this Agreement at any time without notice.
